There is still time for you to file your 2007 tax return and receive your refund, and there is no late filing penalty on your federal return if you are due a refund. You have three-years after the due date of a tax return to file your return and claim any refund. Once the three-year statute expires, you will be unable to receive your refund, however you still must file your return.
Many tax benefits were available in 2007 including, EIC, additional child tax credit, education credits, and the option to claim the state and local sales tax deduction when itemizing. These benefits are available as long as the tax year is open. In addition, you must file to claim any refund due you, including the EIC, even if you are not required to file.
IRS e-file is not available for prior year tax returns at this time, so the return must be mailed. Your 2007 tax return must be post-marked by midnight April 18, 2011 to receive your refund. Those refunds not claimed by April 18, 2011 will be turned over to the U.S. Treasury.
